Disclosure Text for Website Form Fields Pursuant to Personal Data Protection Legislation

The personal data that you will share with us through the form fields on the website, namely the Contact Us and Communication Form, will be processed by Fi Commerce Teknoloji Ticaret Anonim Şirketi (“FiCommerce” or the “Company”) within the scope of the purposes specified in the Law on the Protection of Personal Data No. 6698 (“KVKK”) and detailed below.
1. Definitions Related to KVKK
In the implementation of the KVKK:
- Anonymization: Making personal data impossible to be associated with an identified or identifiable real person in any way, even by matching it with other data,
- Data Subject: The real person whose personal data is processed,
- Personal Data: Any kind of information relating to an identified or identifiable real person,
- Processing of Personal Data: Any operation performed on data such as obtaining, recording, storing, preserving, altering, reorganizing, disclosing, transferring, taking over, making available, classifying, or preventing its use, wholly or partially by automatic means or by non-automatic means provided that it is part of any data recording system,
- Board: The Personal Data Protection Board,
- Authority: The Personal Data Protection Authority,
- Data Processor: The real or legal person who processes personal data on behalf of the data controller based on the authority granted by him/her,
- Data Recording System: The recording system in which personal data is processed by being structured according to specific criteria,
- Data Controller: The real or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system,
- Special Categories of Personal Data: Data relating to individuals’ race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, clothing and attire, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as biometric and genetic data,
shall mean these.
2. What is Personal Data? Which Personal Data is Processed?
Personal data is any kind of information that identifies you or makes you identifiable. In this context, any information that can be associated with you, primarily your identity information such as your name and surname, Turkish ID number, as well as your address and phone information, bank account information, is referred to as “Personal Data.” Data regulated under Article 6 of the KVKK, such as your race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as your biometric and genetic data, are referred to as “Special Categories of Personal Data.”

4. Method of Personal Data Collection
Your personal data is processed, in line with the information and documents provided through the form on our website; verbally, in writing or in an electronic environment, by various methods that are fully or partially automatic or non-automatic as part of any data recording system.
5. How Is the Security of Personal Data Ensured?
FiCommerce places great importance on protecting the confidentiality and security of Personal Data. In this context, necessary technical and administrative security measures are taken to protect Personal Data against unauthorized access, damage, loss or disclosure. Accordingly, necessary system controls, data access controls, secure transfer controls, business continuity controls and other necessary corporate controls are implemented. In addition, special categories of personal data are processed by taking adequate measures determined by the Authority.
6. Do We Transfer Your Personal Data to Third Parties and/or abroad?
(i) Your personal data, in accordance with Article 8 of the KVKK and other relevant legislation:
- To Authorized Public Institutions and Organizations within the country for the purposes of conducting activities in compliance with the legislation, conducting finance and accounting affairs, providing information to authorized persons, institutions and organizations, and following and conducting legal affairs,
- To Lawyers from whom we receive services by contract for the purposes of following, conducting legal affairs and conducting contract processes,
- To our Business Partners such as auditing firms for the purpose of maintaining the organization of activities carried out within the scope of our partnership plans as FiCommerce,
- In accordance with the relevant legislation, commercial electronic communication consents are required to be registered with the Message Management System (İYS), and in this context, communication address (phone number and/or email address), consent date, communication channel, recipient type and consent source data are shared with İYS,

7. What Are Your Rights as the Data Subject and What Is the Application Procedure?
Your Rights Regarding Your Personal Data
We would like to state that you have the following rights regarding your data processed within FiCommerce:- To learn whether your Personal Data is being processed,
- If your Personal Data is processed, to request information regarding this,
- To learn the purpose of processing your Personal Data and whether it is used in accordance with its purpose,
- To learn who the third parties to whom your data is transferred domestically are, if any, and which data is transferred,
- To request the correction of your Personal Data if it is incomplete or incorrect,
- To request that, in case of correction, deletion or destruction of your Personal Data, these processes be notified to the third parties to whom your Personal Data has been transferred,
- To request the deletion or destruction of your processed Personal Data in case the reasons requiring its processing no longer exist or your Personal Data loses its currency,
- To object to a result against you arising from the analysis of your processed Personal Data exclusively through automated systems,
- To demand compensation for the damage if you suffer damage due to the unlawful processing of your Personal Data.
You can send us your requests regarding these rights using the application procedures specified below.
Application
You can submit your requests regarding your Personal Data to our Company by filling out the application form on our website and delivering it in writing to the address specified in the last section by hand delivery, mail or courier, via notary, with secure electronic signature and mobile signature to our registered electronic mail (KEP) address, or via the email address info@ficommerce.com by using the electronic mail address you have previously notified to us and which is registered in our system.FiCommerce will conclude the requests directed to it as soon as possible and at the latest within thirty days, free of charge, depending on the nature of the request. In the event that fulfilling your requests causes a cost, we may request only the fees in the tariff determined by the Board.
As a result of the requests directed to FiCommerce, we may accept the requests or reject them by explaining the reason and communicate this response in writing or electronically to the person making the request.
